Independent Fiduciary & Plan Trustee Services

With decades of experience representing and regulating benefit plans, Lisa serves as a professional trustee for retirement and health plans.  Lisa can also serve as an independent fiduciary for retirement and health plans, including Taft-Hartley multiemployer plans, Employee Stock Ownership Plans (ESOPs), and other employer-sponsored benefit arrangements

Legal Services and Counsel

In addition to consulting and strategic regulatory and policy work, Lisa is a licensed attorney with decades of experience advising clients on complex issues under ERISA, the Federal Employees Health Benefits Act, and related employee benefits laws. Lisa is admitted to practice in the states of New York and New Jersey, as well as in several federal district courts and the U.S. Court of Appeals for the Second Circuit.

Lisa has extensive experience representing Taft-Hartley multiemployer defined benefit and defined contribution pension plans; fully insured and self-insured health and welfare plans; apprenticeship and training programs; supplemental benefit plans, including training and childcare/elder care benefits; and single employer pension and health plans. She also has nearly thirty years of experience representing a large federal employee health benefits (FEHB) plan covering more than 100,000 enrollees and their dependents, involving annual negotiations and frequent interaction and collaboration with the U.S. Office of Personnel Management; knowledge of federal contracting requirements; litigation; and other legal work related to enforcement of the plan’s federal contract with respect to health providers, service providers and enrollees.  She has negotiated contracts with pharmacy benefit managers and other service providers in alignment with FEHB and other federal procurement requirements.

In her long tenure as a respected employee benefits attorney, Lisa has counseled clients in all aspects of benefit plan compliance and administration, including plan design and drafting; fiduciary responsibility; compliance with applicable laws and regulations including ERISA, Internal Revenue Code, American Rescue Plan Act, SECURE and SECURE 2.0, Pension Protection Act, Multiemployer Pension Reform Act, American Rescue Plan Act, the CARES Act, Affordable Care Act, HIPAA Privacy and Security, COBRA, Medicare Secondary Payer, NYC Controller’s Directive 12; and internal governance issues. In addition, Lisa has:

  • Drafted and amended trust agreements and governing plan documents, summary plan descriptions, summaries of material modifications, summary annual reports, summaries of benefits and coverage, participant notices and communications;
  • Provided guidance on compliance with reporting and disclosure requirements and effectiveness of participant communications;
  • Prepared restated pension plan documents and requests for IRS determination of qualified status; prepared applications for IRS determination of tax-exempt status under Internal Revenue Code §501(c); Consulted on benefit claims and appeals, subrogation, and provider disputes;
  • Reviewed insurance applications and policies; interacted with brokers and insurers;
  • Reviewed service provider agreements; interacted with vendors including preferred provider organizations, pharmacy benefit managers, insurers, actuaries and consultants, investment advisors, investment managers, independent accountants and auditors, third-party administrators, custodians, and recordkeepers;
  • Drafted and amended internal policies and procedures, including those related to travel and expense, conflict of interest, collection of delinquent employer contributions, payroll audits, benefit claims and appeals, HIPAA Privacy and Security, trustee training, HIPAA Privacy and Security training;
  • Represented clients in Taft-Hartley trustee deadlock arbitrations; benefit claim, fiduciary breach, withdrawal liability and contribution enforcement litigation.;
  • Represented clients in IRS, Department of Labor and U.S. Office of Personnel Management/Office of the Inspector General investigations and audits;
  • Counseled clients on compliance with cybersecurity best practices and standards; and
  • Counseled benefit plan and labor organization clients in general matters such as employment issues (drafting employee manuals; advice on employee issues; workers compensation, etc.) and certain real estate issues (review of leases; liaise with real estate counsel on more complicated transactions). 

Legal services are provided separately from consulting engagements through a distinct attorney–client relationship, only after execution of an engagement agreement.  

Expert Witness Services
Lisa serves as an expert witness in litigation involving ERISA, fiduciary duties, benefit plan design and administration, mental health parity, and related issues. Her testimony is informed by decades of legal experience and her leadership as a regulator, bringing authority and credibility to complex matters.
